Overview

The Children and Families Act 2014 gave the Secretary of State for Health the powers to legislate to introduce a minimum age of sale for nicotine products, such as electronic cigarettes, to protect the health of children and young people.

The regulations would make it an offence for a retailer to sell nicotine inhaling devices to anyone under the age of 18, consistent with existing legislation relating to the sale of tobacco products. The regulations would apply to any device that can be used for inhaling nicotine, as well as to refill cartridges and nicotine liquids for the devices.

The purpose of this consultation is to seek views on draft regulations that would introduce a minimum age of sale for the purchase of nicotine inhaling products, including e-cigarettes, in England and Wales.  The draft regulations and consultation document explain how the restriction would work in practice.
